Right of Withdrawal
The consumer has the right to withdraw from the distance purchase contract without having to provide any reason and without any penalty, within fourteen (14) days from the date of receipt of the products, as provided by the Consumer Code (Legislative Decree 206/2005 and subsequent amendments).
To exercise the right of withdrawal, the Customer must communicate to PhytoItalia S.r.l. their intention to withdraw from the contract within the aforementioned timeframe.
Methods of Exercising the Right of Withdrawal
The Customer can exercise the right of withdrawal by sending a written communication via registered letter with acknowledgment of receipt to the following address:

Online Withdrawal Request
Pursuant to Article 54-bis of the Consumer Code, for contracts concluded online, the consumer can also exercise the right of withdrawal through the specific digital function made available by PhytoItalia.
To facilitate the exercise of the right of withdrawal, PhytoItalia has provided the "Request Withdrawal" button, which is clearly visible and always accessible from the footer of the website.
The function is also directly reachable at the following address: https://www.phytoitalia.it/it/italia/recesso/.
Submitting the request through this procedure allows the consumer to communicate their intention to withdraw from the contract in a simple, quick, and traceable manner.
Once the request is received, PhytoItalia will send the consumer a confirmation of receipt of the withdrawal communication on a durable medium, containing the date and time of the request.
Refund
In the event of exercising the right of withdrawal, PhytoItalia will refund all payments received from the consumer, including the costs of standard delivery that may have been incurred for sending the products.
Any additional costs resulting from the choice of a delivery method other than the standard less expensive option proposed by PhytoItalia will not be refunded.
The refund will be made within fourteen (14) days from the date on which PhytoItalia is informed of the Customer's decision to withdraw from the contract.
PhytoItalia may withhold the refund until the returned products are received or until the Customer has provided proof of having shipped them back, depending on which situation occurs first.
Return of Products
The Customer is required to return the products without undue delay and in any case within fourteen (14) days from the date they communicated their decision to withdraw from the contract.
The direct costs of returning the products are the responsibility of the Customer, unless otherwise expressly indicated by PhytoItalia.
The right of withdrawal applies to the purchased product in its entirety. If the product consists of multiple components or parts, it is not possible to exercise the withdrawal limited to only one part of the purchased product.
Conditions for Exercising the Withdrawal
The product must be returned intact, complete with all its parts, accessories, instructions, and original packaging, normally preserved and kept with the use of ordinary diligence.
The Customer is solely responsible for any decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the products.
Exclusions from the Right of Withdrawal
The right of withdrawal is excluded in the cases provided for by Article 59 of Legislative Decree 206/2005, including:
- the supply of products made to measure or clearly personalized;
- the supply of products that risk deteriorating or expiring rapidly;
- the supply of sealed goods that are not suitable for return for hygiene or health protection reasons and that have been opened after delivery;
- the supply of goods that, after delivery, are by their nature inseparably mixed with other goods.
The right of withdrawal also does not apply to purchases made by individuals acting in the exercise of their entrepreneurial, commercial, artisanal, or professional activities, including purchases for which an invoice with VAT has been requested.
